ARTICLE 1: OBJECT

These General Terms and Conditions of Sale govern all sales made through the website www.glass-for-fireplace.com by the company Novis stav s.r.o., with registered office at Lazy VII/4365, Zlín 76001, Czech republic, and registered in the Czech Trade and Companies Register under number CZ29185629 (hereinafter referred to as "the Seller").

They define the rights and obligations of the Seller and the Customer in the context of any purchase made on the website.

These Terms apply without restriction or reservation to all purchases by non-professional buyers (consumers), within the meaning of applicable consumer law, who wish to acquire products offered for sale by the Seller on the website.

The Customer declares that they have read and accepted these Terms before confirming their order. Confirmation of the order implies acceptance of these Terms without exception or reservation.

The Seller reserves the right to modify these Terms at any time. In case of modification, the applicable Terms are those in force on the date of the order by the Customer.

ARTICLE 2: PRODUCTS

The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions occur, the Seller shall not be held liable.

The photographs of the products are not contractual.

The main characteristics of the products, including the specifications, dimensions, and materials, are presented on the website.

Some products, such as fireplace glass panels, are custom-made based on dimensions provided by the Customer. In such cases, the Customer is solely responsible for the accuracy of the measurements and the product configuration ordered.

ARTICLE 3: ORDERS

The Customer selects the products they wish to order on the website.

The contractual information is presented in English and will be confirmed at the latest upon order validation.

The Customer has the opportunity to check the details of their order, its total price, and to correct any errors before confirming the order. This confirmation implies acceptance of the entirety of these Terms and constitutes proof of the sales contract.

The sale will only be considered valid after full payment of the price. Once the order is validated, the Buyer will receive an order confirmation acknowledging receipt and registration of the order. It is the Customer’s responsibility to verify the accuracy of the order and to report any error immediately.

Please note that we cannot make any changes to a custom-made product order that is already in production.

The Seller reserves the right to refuse any order from a Customer with whom there is an ongoing dispute, particularly relating to payment or any other issue concerning a previous order.

ARTICLE 4: PRICES AND PAYMENT

The prices are indicated in euros, including VAT for B2C sales within the EU. For B2B customers in the EU, if a valid VAT number is verified during the order process, the prices will be displayed excluding VAT. If a valid VAT number is provided in the company information, the total price will be calculated without VAT. Delivery costs will be indicated before the order is confirmed. The total amount due is specified during the order confirmation.

The Seller reserves the right to modify its prices at any time. However, the product will be invoiced on the basis of the rate in effect at the time of order validation.

Payment is made online by credit card or other secure payment method accepted by the Seller.

ARTICLE 5: DELIVERY

The products are delivered to the address indicated by the Customer during the ordering process. The Customer must ensure its accuracy. Any package returned due to an incorrect or incomplete address will be reshipped at the Customer’s expense.

For our products, delivery costs and times are detailed in our Delivery Guide, under the Shipping and Delivery section for each country. Delivery times are given as an estimate.

The Seller shall not be held liable for delays in delivery due to external causes (e.g., carrier delays, customs, force majeure).

In case of damage during transport, the Customer must notify the Seller within 24 hours of receipt of the goods. The notification must include clear photographic evidence of the damage and be submitted via the procedure outlined in the “Complaints” section of our e-shop. Failure to do so within this timeframe may result in the claim being refused.

ARTICLE 6: RIGHT OF WITHDRAWAL

IMPORTANT: In accordance with Article 16(c) of the EU Consumer Rights Directive, the right of withdrawal does not apply to the supply of goods made to the consumer's specifications or clearly personalized.

Therefore, no withdrawal or return is possible for custom-made products (such as heat-resistant fireplace glass cut to size or gaskets cut to size). 

Please ensure all measurements are correct before placing your order, as modifications, cancellations, or returns are not possible after manufacturing begins.

For non-customized products, the Customer has a period of 14 days from receipt to exercise the right of withdrawal, without having to give any reason or pay penalties. The return costs remain at the Customer’s expense.

Returned products must be in perfect condition, in their original packaging, and accompanied by the invoice sent to: Novis stav s.r.o., Šrámkova 1211, Zlín 76302, Czech republic.

ARTICLE 7: WARRANTY

The products sold by the Seller benefit from the legal guarantees of conformity and hidden defects, in accordance with EU legislation.

In case of non-conformity or defect, the Customer must notify the Seller within a reasonable time and provide supporting evidence (photos, description, etc.).

The Seller will either replace or refund the product, as appropriate.

Any warranty is excluded in case of misuse, improper installation, or modification of the product by the Customer.

ARTICLE 8: LIABILITY

The Seller cannot be held liable for any damage resulting from improper use or incorrect installation of the product by the Customer

The Seller’s liability is limited to the amount of the order.

ARTICLE 9: FORCE MAJEURE

The performance of the Seller’s obligations may be suspended in case of an event constituting force majeure (e.g., strike, fire, flood, pandemic, interruption of transport or supply chain).

ARTICLE 10: PERSONAL DATA

The Seller undertakes to protect the Customer’s personal data, which are collected and processed in compliance with applicable data protection laws, including the GDPR.

The Customer has the right to access, rectify, and delete their personal data by contacting the Seller at info@glass-for-fireplace.com.

ARTICLE 11: APPLICABLE LAWS AND DISPUTES

These Terms are governed by Luxembourg law.

In case of a dispute, the Customer must first contact the Seller to seek an amicable resolution.

If no agreement is reached, the Customer may resort to the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Failing this, any dispute will fall under the exclusive jurisdiction of the competent courts of Luxembourg.
